The CEQA review begins by determining if a proposed project is subject to CEQA regulations, as various exemptions apply. When a project is exempt or not subject to CEQA, the lead agency can file a notice of exemption. For non-exempt projects, the lead agency may conduct an initial study to evaluate potential significant environmental impacts. This study serves as a preliminary evaluation rather than a comprehensive assessment like an Environmental Impact Report (EIR), helping the agency decide whether an EIR or a negative declaration is warranted.
Depending on the initial study's findings, the environmental document type is selected as follows:
- Environmental Impact Report (EIR): Required when substantial evidence indicates that the project may cause a significant environmental impact.
- Negative Declaration: Prepared if there is no substantial evidence of significant environmental effects, or if project modifications eliminate potential significant impacts identified in the initial study.
- Mitigated Negative Declaration: Prepared when the initial study identifies potential significant effects, but conditions of approval incorporate mitigation measures that lower all impacts to a less-than-significant level.
Ultimately, projects subject to CEQA typically undergo review by the Board of Public Works (BPW) and/or the City Council, which hold the authority to approve the project as submitted, approve it subject to conditions, or deny approval.
